Application Agreement (Please read carefully)
CREDIT AGREEMENT 1. CAVE SHEPHERD & CO. LTD., (CAVE SHEPHERD) agrees to permit the undersigned (“the Customer”) and any person authorised by the Customer and to whom a card has been issued to purchase goods and services on credit from CAVE SHEPHERD and/or any other company which may in future accept the Card subject to the terms and conditions of this Agreement. 2. CREDIT CARD i) The Customer shall comply with any instructions which CAVE SHEPHERD may give regarding the use and safekeeping of its Credit Card (“the Card”) issued pursuant to this Agreement. ii) All authorised users are jointly and severally liable for all transactions and charges debited to their account. iii) The Customer shall provide CAVE SHEPHERD with a list of the names and signatures of all persons authorised to use the Card. 3. LINE OF CREDIT The Customer agrees that a line of credit will be established and/or cancelled by CAVE SHEPHERD to a limit which will be determined from time to time at the sole discretion of CAVE SHEPHERD. Changes in the credit limit may be notified to the Customer on each monthly statement. The Customer agrees to immediately repay any amount in excess of the credit limit. 4. PAYMENT OF SERVICE CHARGES AND/OR FEES i) The Customer shall pay on or before the date shown on each monthly statement either the full balance or at least the minimum payment required on the statement. Payments shall be applied first towards service charges owing and then towards the balance due. ii) The service charge rate is 1.75% per month. CAVE SHEPHERD has the right to change the service charge rate, provided that prior notice is sent to the Customer. iii) The larger the payment made by the Customer towards the balance due to CAVE SHEPHERD the smaller the service charges payable by the Customer. iv) If the Customer pays the full balance, no service charge will be applied provided the Customer’s payment is made by payment date shown on the statement and provided also that the Customer’s account is not in arrears. v) The Customer agrees to pay the annual fee (presently $20.00 per annum) which the Company may charge to the Customer’s account. 5. DEFAULT IN PAYMENT In case of default in payment, the full balance together with accrued service charges shall immediately become due and payable, plus all costs incidental to the recovery of the amount due. In the event that any cheque submitted by the Customer in payment of the Customer’s account is not honoured upon presentation, CAVE SHEPHERD has the right to levy a fee of $35.00 against the Customer for each cheque so dishonoured to reimburse its handling charges. 6. LOSS OF THE CARD The Customer must notify CAVE SHEPHERD as soon as possible if the Card is lost, stolen or being misused. 7. VARIATION CAVE SHEPHERD may vary this Agreement at any time subject to any legal requirements about notice. In particular, CAVE SHEPHERD may introduce a charge for any service provided under, or in connection with this Agreement from time to time. 8. LIABILITY OF CUSTOMER i) Until the Customer notifies CAVE SHEPHERD of any loss of the Card the Customer will be liable for all purchases and charges made prior to such notification. If the Customer wishes to cancel the Card or any additional card(s) he shall be responsible for returning the same to CAVE SHEPHERD. ii) The Customer understands that any goods or services purchased with the Card are not insured by CAVE SHEPHERD against any perils (such as fire, theft) and agrees that it is the Customer's responsibility to provide such insurance coverage on any purchases. The Customer also understands that in the event of the death of the Customer, his/her Estate will be liable for any outstanding balance owing to CAVE SHEPHERD in respect of the Card holders' account.
